General Terms and Conditions of Sale

This document establishes the pre-contractual information regarding distance contracts concluded through the address www.lscosmetics.pt as referred to in Article 4 of Decree-Law no. 24/2014 of February 14, and all subdomains, digital applications, or sub-websites.

The registered trademark L&S Cosmetics and its respective domain www.lscosmetics.pt are owned by Sérgio Correia dos Santos, with headquarters at Rua São João de Sobrado 955, Sobrado, 4440-339, Valongo, individual NIF number 214730549, hereinafter abbreviated as L&S Cosmetics.

L&S Cosmetics reserves the right to freely modify this pre-contractual information to adapt it to applicable legislation, without prior notice, advising users to check it frequently.

Both browsing and purchasing through the website and/or digital applications imply acceptance of the present information and practices described in this document and the Exchanges and Returns policy. Online sales are valid and applicable to the territories of Continental Portugal, the Archipelagos of the Azores and Madeira, and countries belonging to the European Union.

Availability of item(s)

The online sale of item(s) does not effectively guarantee the real-time existence of available stock at the time of purchase, and given that a portion of our items are of foreign production, we appreciate your understanding regarding delivery times.

If the desired item(s) is not available, whether permanently or temporarily, and the estimated delivery exceeds the time referenced in the online store, L&S Cosmetics will immediately communicate with the customer, via phone or email, indicating the estimated date for its replenishment. According to the information provided, the decision regarding the permanence or cancellation of the respective purchase will be at the customer's discretion.

We inform you that some items available in the online store are subject to ordering from the supplier, whose communicated delivery times are estimates, and for which L&S Cosmetics is not responsible for delays that may occur in orders.

Shipping and delivery

Whenever the necessary conditions for the delivery of items in a single shipment are not met, whether due to delay or temporary unavailability of a portion of the order, L&S Cosmetics will carry out a phased delivery, with the customer being informed in advance by email.

The shipment of item(s) for which stock allows immediate delivery will be made on the next business day, with an estimated delivery for Continental Portugal of 2-3 business days. Regarding international shipping, despite the order being dispatched on the next business day, the reception time depends on the region and country, with a timeframe between 2 and 30 business days.

Without prejudice to what is established in the previous clause, regarding the availability of item(s) and, unless extraordinary circumstances occur, orders will be shipped within the date provided in the Shipping Confirmation, provided by L&S Cosmetics during the purchase process.

Nevertheless, delays may occur for the reasons mentioned below:

• Customization of item(s);
• Special item(s);
• Unforeseen circumstances or delivery areas.
• Holiday seasons with higher order flow from distributors
• Customs control (clearance)

If, for any reason, we cannot meet the delivery date, we will inform you of this circumstance by establishing a new date.

In the event that it is not possible to meet the delivery date specified in the Shipping Confirmation, L&S Cosmetics will immediately communicate with the customer, via telephone or electronic contact, indicating the estimated new date. Any delay verified in the dispatch of the item(s), compared to the presented estimated dates, does not entitle the customer to any compensation.

L&S Cosmetics only dispatches orders on business days. Therefore, neither weekends nor holidays are counted for estimated order delivery. In any case, the estimated delivery dates are merely indicative.

Upon delivery, the customer must check that the packaging is in perfect condition. In case of deformity, visible defect, or error in the requested product, they must refuse the order with the courier of the transport company, filling out the form intended for these cases, indicating the problem found.

For the purposes of these conditions, it will be understood that "delivery" has occurred or that the order has been delivered when the responsible person present at the agreed address signs.

L&S Cosmetics does not deliver to PO boxes.

Export (Switzerland and United Kingdom)

Exports of goods to non-EU countries are not subject to VAT (Article 14 of the CIVA code). In these cases, VAT is charged and due in the country of import, and it is the customer/purchaser's responsibility to settle the VAT and any customs fees with the competent authorities of the destination country.

The customs clearance of the goods is the sole responsibility of the purchaser. L&S Cosmetics guarantees the sending of all mandatory documentation (invoice, waybill, etc.) for export.

Before making your purchase, please contact our customer support to find out the conditions for purchasing products without VAT under this regime.

B2B Export within the EU (VAT exemption)

If the customer is a VAT taxpayer (individual or legal entity engaging in an economic activity / self-employed worker) with a valid taxpayer number for transactions of goods within the EU, please contact our customer support so that we can open a B2B customer account with VAT exemption. The customer can verify the validity of their number in the VIES system (https://ec.europa.eu/taxation_customs/vies/?locale=pt)

Impossibility of delivery

The delivery of the item(s) will be made to the address indicated at the time of purchase. In the event that delivery does not materialize due to the absence of someone responsible for its reception, due to the characteristics of the delivery location, or due to the volume and weight of the order, the carrier will issue a notice or contact to coordinate the day and time of the new delivery.

If delivery is not possible on the agreed date or address in advance, the customer must communicate this to L&S Cosmetics as soon as possible, in order to establish a new delivery agreement.

In case the order is returned to L&S Cosmetics due to reasons that prevented its delivery - absence at the address, failure to collect or clear customs, insufficient/incorrect address, or other errors on the customer's part - L&S Cosmetics is not responsible for re-shipping costs. Re-shipping fees and costs for the item(s) are applied to the customer on the second delivery attempt.

Purchases and payments

For purchases made through our online store and, after selecting the desired item(s), L&S Cosmetics does not require prior and mandatory registration from the customer, which does not imply the need to fill out the form available at the shopping cart checkout and the express acceptance of this legal information, available for consultation on the website www.lscosmetics.pt

For optimized security, all purchase transactions take place within a strict scope of confidentiality and encryption according to the SSL protocol.

If, in the long term, the customer wishes to make more purchases in our online store, they can choose the "Create account?" option, associating a password with the email indicated in that form, which will allow them to save billing, shipping, and contact details for future purchases, and create an account with the combination of said credentials.

On the website www.lscosmetics.pt, L&S Cosmetics offers the User the following payment methods via Easypay - Instituição de Pagamento Lda:

1. Credit Card (Visa, Mastercard);
2. Multibanco Reference
3. MBWay
4. Bank Transfer

In the case of credit card payment, the debit will be made to the User's card immediately after confirmation of the service provision capacity. If any of the ordered services cannot be provided, their value will be credited to the User's card after the order is closed.

After using the Multibanco reference, an email is automatically sent to the customer and to L&S Cosmetics, indicating that the payment was successful.

If you choose Bank Transfer, upon completing your purchase you will receive information with our bank details where you will have 5 days to make the payment. After this period and if your payment is not confirmed with our banking institution, your order will be canceled due to non-payment and the customer will be informed of this.

Prices and payment

The prices of the items existing in the online store are those stipulated, at any given time (except for typographical errors), which are in € (euros) and include the applicable VAT rate, according to the legislation in force at the time of purchase, but not shipping costs.

The total amount payable for the order includes the sum of the item(s) value with the applied VAT rate, additional services (if any), and delivery fee.

L&S Cosmetics undertakes to make every effort to minimize errors in the price list of our items, however, if incorrect price(s) of the ordered item(s) are found, L&S Cosmetics will inform the customer as soon as possible. The customer will then decide whether to cancel or adjust the total of the respective purchase, if the price is higher. If the product price is lower than the advertised price, L&S Cosmetics will refund the difference.

If contact with the customer is not possible, L&S Cosmetics reserves the right to cancel the order, and the customer will be fully reimbursed for the amount paid, with no right to any compensation for the cancellation.

L&S Cosmetics disclaims any obligation to supply item(s) whose price is found to be incorrect due to an obvious and unequivocal error, even if a Shipping Confirmation has been issued.

With the exception of the clauses previously established, the price(s) of the item(s) may be changed at any time, without prior notice and without the changes affecting orders for which L&S Cosmetics has already sent an Order Confirmation.

In case of suspected fraud in the payment process, L&S Cosmetics reserves the right to postpone the order until the suspicion is clarified.

Product Information

L&S Cosmetics reserves the right to modify at any time the information and commercial offer presented regarding: Products, prices, promotions, commercial conditions, and services.

Every effort has been made to ensure that the information presented in our online store is free from typographical errors, and whenever these occur, L&S Cosmetics will correct them as soon as possible.

In the event that the photographs of the item(s) do not correspond to the described information, we ask that you contact L&S Cosmetics for clarification.

The photographs of the items available in the online store are as faithful as possible, aiming to reproduce the item(s) as it truly is. However, L&S Cosmetics alerts to slight differences between photographs and the final item(s) that may occur due to packaging differences, labeling, or color deviation due to monitor calibration reasons.

In case the presented information does not correspond to the real characteristics of the item(s), the customer has the right to terminate the purchase and sale agreement under the applicable legal terms.

The catalog of items sold in the online store www.lscosmetics.pt is independent of the physical store(s), both in terms of price and stock quantities. All promotional campaigns have limited and exclusive stock for online sales.

The brands and names of the items, possibly used in the online store, are the property of their respective companies or businesses.

The navigation and consultation of information published on the online store www.lscosmetics.pt by users is entirely free, not establishing any commercial or professional relationship between them.

Non-personal data

All information, communications, and other material data sent through our online store, electronic contact, or direct delivery to the address of L&S Cosmetics, which do not constitute personal identification, will be considered non-confidential data, exempt from the protection covered by the privacy and data protection policy.

L&S Cosmetics reserves the right and freedom to use or reproduce ideas, concepts, know-how, or techniques contained in the information sent, regardless of the purpose, including the development, manufacturing, or marketing of new items.

Under penalty of recourse to competent legal means against anyone acting otherwise, the information and content sent by customers must fully respect legality, especially in terms of Copyright.

Intellectual and industrial property

By accessing the online store www.lscosmetics.pt, the user is granted a limited, non-exclusive license to use the said site, solely for their private use, regarding the content of the website.

The online store is protected by Copyright and Related Rights and by Industrial Property Rights, as are all the elements that comprise it (such as trademarks, logos, photographs, images, illustrations, texts, video clips, etc.) are the exclusive property of L&S Cosmetics or of suppliers/partners who have authorized their publication, the only entities authorized to use the Intellectual Property Rights and associated personality rights, and this does not grant any license or any right to the user beyond that of consulting the website.

The reproduction of any documents published in the online store is only authorized for exclusive informational purposes, for strictly personal and private use. Any reproduction or representation, in whole or in part, of the website or any of its constituent elements, on any medium whatsoever, and in any form whatsoever, for other purposes, namely commercial, is expressly prohibited.

Warranties

In accordance with the legislation in force at any given time, products sold by L&S Cosmetics to consumers (an individual acting for purposes that are not within the scope of their commercial, industrial, craft, or professional activity) are covered by a legal guarantee of conformity for consumer goods corresponding to a period of 3 (three) years for contracts entered into from January 1, 2022, in accordance with Decree-Law no. 84/2021, of October 18, including refurbished goods.

Exclusion of warranties and liability

The user acknowledges and accepts that the use of the website is their sole and exclusive responsibility.

L&S Cosmetics does not generally control the use that users make of the website and, in particular, does not guarantee that users will use the website in accordance with the Law, these terms of use, morality, and good customs commonly accepted in public order, nor that they will do so diligently and prudently.

L&S Cosmetics does not warrant or represent that this website and/or any of the materials offered on it will be accurate, reliable, correct, useful, provided in a timely manner, uninterrupted, secure, free of defects, or free of errors.

The website and all materials offered on it are intended solely for general customer information purposes. Neither the website nor any materials are intended to constitute (and do not constitute) the practice of advice or the provision of content, data, software, information, products, and/or services. Any mentions of professionals or information (including, but not limited to, their content and results) contained in or provided through the website are intended solely for general customer information purposes and do not imply endorsement by L&S Cosmetics or that it has any association with those professionals.

L&S Cosmetics will only be liable for damages that the user may suffer as a result of using the website when these are attributable to its willful misconduct, and the user acknowledges and accepts that the use of the website and the services offered is carried out under their sole responsibility and risk. In jurisdictions that do not allow the exclusion and limitation of certain warranties, L&S Cosmetics' liability will be limited to the extent permitted by law.

Exchange and return

If you are not satisfied with your order or if the item(s) is defective, the customer may proceed with the exchange or return of the item(s) within 15 days, counting from the day on which physical possession of the item(s) is acquired.

The item(s) must necessarily be in the same original conditions in which it was sold, without signs of improper use, in its original packaging (if existing), and accompanied by all its accessories (if existing), as well as accompanied by the invoice proving the purchase of the respective item(s) acquired in our online store.

Additionally, item(s) specially manufactured to measure or clearly personalized according to customer specifications are excluded from the right to exchange and return.

For hygiene and safety reasons, products that are not sealed by the manufacturer (e.g., nail polish, gel nail polish, gel, creams, etc.) cannot be exchanged.

To exercise the right of withdrawal, the customer must notify L&S Cosmetics of their decision unequivocally (e.g., via email) before the deadline defined in this pre-contractual information, using the email info@lscosmetics.pt or by calling +351 911 106 221.

The customer must return the item by registered mail, along with the receipt, and bear all shipping costs for the return or exchange of the item(s).

In the case of returning item(s) which, by their nature, cannot be returned by regular mail, the customer must bear the direct costs of said return, which are associated with shipping costs.

L&S Cosmetics is not responsible for damages or loss of item(s) during the return process.

After contacting L&S Cosmetics and receiving return instructions, you may send the item(s), properly packaged, in their original packaging to the following address: L&S Cosmetics, Rua São João de Sobrado 957, Sobrado, 4440-339, Valongo.

Items will be checked upon arrival at our physical store, and only those that comply with the return conditions will be accepted for exchange or return.

Offers

In the event of a return of item(s) that were a gift, the refund will be made to the customer who placed the order on the website.

Refund

The customer will only be refunded after validation that the item(s) is in the same original condition in which it was sold and complies with all the requirements mentioned in the Exchange and Returns condition. The customer is advised to be careful with the item(s) while in their possession.

Shipping costs for returned item(s) will not be refunded, and in cases of returns where the product has not yet been shipped, refund processing fees will be applied to the customer.

The refund of the value of the returned item(s) will be made through the same payment method used by the customer in the online purchase (Multibanco Reference, Credit Card), after validation of compliance with the return conditions described above. L&S Cosmetics has a maximum period of 14 days to do so, from the date of receipt of the item(s) at the previously mentioned address.

For a faster refund process, in the case of amounts paid by Credit Card and Multibanco with the associated NIB/IBAN indicated, the refund will be made to the same payment method.

In the case of payment by Multibanco without the associated NIB/IBAN indicated, L&S Cosmetics requests the customer to provide the missing data.

Regardless of the payment method, it is the customer's responsibility to verify the refund on the Credit Card statement or Bank Account balances.

Resolution

Without prejudice to liability for any damages that may result, L&S Cosmetics may, immediately and without prior notice, terminate its relationship with the user and discontinue their access to the website or corresponding services if it detects use of the same or any of the services linked to it that is contrary to the applicable conditions.

Changes

L&S Cosmetics may, at any time and without prior notice, change the presentation and configuration of the website, as well as these conditions or, if applicable, introduce new terms of use by publishing them on the website, so that they can be known by the user when accessing it and before using it.

The use of the website, once the applicable changes have been made, will imply the user's acceptance of the said modified conditions.

Governing law and jurisdiction

Portuguese Laws apply in Portugal, and the parties submit to the exclusive jurisdiction of the Portuguese Courts.
